Any order placed on the site implies acceptance of these General Terms and Conditions of Sale.

ARTICLE 1 – Intellectual Property

The brand Gémeaux® is a brand duly registered with the Moroccan Office of Industrial and Commercial Property (OMPIC). As such, it benefits from the protection conferred by Law No. 17-97 on the protection of industrial property, as amended and supplemented.

All elements comprising the website www.gemeauxboutique.com, including, but not limited to, texts, images, photographs, videos, illustrations, logos, trademarks, graphic elements, visual charts, sounds, databases, as well as any other content, are protected under intellectual property law.

Any reproduction, representation, distribution, adaptation, integration, exploitation or use, total or partial, of any nature whatsoever, without prior, express and written authorization, is strictly prohibited and constitutes an act of infringement, liable to engage the civil and criminal liability of its author, in accordance with articles 201 to 204 of the aforementioned Law, as well as international conventions ratified by the Kingdom of Morocco.

We reserve the right to initiate any necessary legal proceedings to preserve its rights.

ARTICLE 2 – Order Formation and Acceptance

Any order placed on the site www.gemeauxboutique.com constitutes a firm and definitive offer to purchase the selected products, in compliance with these General Terms and Conditions of Sale (GTCS).

The order is considered accepted only after express confirmation from us, subject to:

  • the actual availability of the items,
  • payment validation,
  • and, if applicable, customer confirmation in case of cash on delivery.

The mere receipt of the order acknowledgment email does not constitute definitive acceptance of the order.

In case of unavailability of an item, a clear error in the displayed price, or any other element affecting the execution of the order, we reserve the right to contact the customer to offer an alternative solution or to cancel the order.

ARTICLE 3 – Right of Refusal and Order Cancellation

GEMEAUX expressly reserves the right to cancel or refuse any order that is contentious, fraudulent or abnormal, without being obliged to justify the reason, particularly in the following cases:

  • Inability to contact the customer for confirmation or verification purposes;
  • Incomplete or incorrect delivery information;
  • Suspicion of fraud or abusive order;
  • Unjustified refusal to respond to a confirmation request within a reasonable time (maximum 48 hours);
  • Obvious error in price or stock display;
  • Or any other reason likely to compromise the proper execution of the order.

For cash on delivery payments, prior contact with the customer is required before any shipment. Failing a response within the allotted time, the order may be canceled automatically.

The customer will be informed without delay of any cancellation decision.

ARTICLE 4 – Delivery and Shipping

Deliveries are made to the address indicated during the order, exclusively within the territory of the Kingdom of Morocco, through approved logistics providers.

Shipping times are estimated between 2 and 7 business days, from the validation of the order, subject to:

  • the availability of items,
  • the verification of the accuracy of the information provided,
  • and the delivery location.

An additional delay may be required in certain exceptional situations. In case of a significant delay or out of stock, the customer will be informed as soon as possible.

Any absence of the customer or unjustified refusal to receive the order may result in the return of the package, as well as the temporary or permanent exclusion of the customer from our database, unless valid justification is provided within a reasonable period.

ARTICLE 5 – Complaints, Exchanges and Returns

Products sold are subject to rigorous quality control before shipment. However, in case of receiving a non-compliant or damaged item, the customer is required to notify us of the complaint by email to one of the following addresses:

The complaint must be submitted within 48 business hours following receipt of the package, and must be accompanied by the following elements:

  • Order number;
  • Detailed description of the defect or damage;
  • Three clear photographs of the item concerned;
  • A short video illustrating the problem.

Return shipping costs are the responsibility of the customer, except in the case of an error attributable to the company (non-compliant product or shipping error).

Subject to acceptance of the request after examination, the customer will be offered:

  • either a credit valid for a future order,
  • or an exchange, subject to available stock.

It is highly recommended to open the package upon receipt, in the presence of the delivery person if possible, to immediately make any reservations to them.

ARTICLE 6 – Personal Data and Confidentiality

The data collected as part of the order is strictly necessary for its processing and delivery. Only essential delivery information (name, address, phone) is transmitted to logistics providers.

No sensitive data is retained or used for commercial purposes without the prior and explicit consent of the customer, in accordance with current Moroccan legislation on personal data protection.

ARTICLE 7 – Applicable Law and Competent Jurisdiction

These General Terms and Conditions of Sale are governed by Moroccan law.
Any dispute relating to their interpretation, execution, or validity falls within the exclusive jurisdiction of the courts of the Kingdom of Morocco.

By validating an order on the site www.gemeauxboutique.com, the customer acknowledges having read and unreservedly accepted all of these General Terms and Conditions of Sale.
